1. The service

Grafnex provides an AI-powered marketing intelligence platform that enables users to create, launch, maintain and monitor advertising campaigns on Meta.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these terms on behalf of yourself or your organisation. By using Grafnex you represent and warrant that you meet these requirements.

3. Account responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorised use of your account at support@grafnex.ai.
• Ensuring that all information you provide to Grafnex is accurate and up to date.

4. Meta usage

Grafnex integrates with the Meta Ads. By connecting your Meta account you:

• Authorise Grafnex to access, read, and manage your Meta ad accounts on your behalf using the permissions you grant via OAuth.
• Confirm that you have the right and authority to manage the Meta ad accounts you connect.
• Agree to comply with Meta's Terms of Service and Advertising Policies.
• Acknowledge that Grafnex is not responsible for Meta's platform availability, or policy enforcement decisions.

5. Acceptable use

You agree not to use Grafnex to:

• Create or launch advertisements that violate Meta's advertising policies or any applicable laws.
• Engage in deceptive, fraudulent, or misleading advertising.
• Access another user's account or data without authorisation.
• Reverse engineer, decompile, or attempt to extract the source code of the platform.
• Use the service to harm, harass, or discriminate against any individual or group.
• Introduce malware, viruses, or other harmful code.

6. Intellectual property

Grafnex and its original content, features, and functionality are owned by Grafnex and are protected by applicable intellectual property laws. You retain ownership of all content and data you bring to the platform (your campaign data, creatives, and Meta Ads history).

By using Grafnex, you grant us a limited, non-exclusive licence to process your data solely for the purpose of providing the service to you.

7. Termination

You may terminate your account at any time by deleting it from your account settings. We may suspend or terminate your access if you violate these terms, with or without notice. Upon termination, your data will be deleted in accordance with our Privacy Policy.

8. Disclaimers

Grafnex is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that campaign recommendations will achieve specific results. Campaign performance depends on many factors outside our control, including Meta's algorithms, market conditions, and creative quality.

9. Limitation of liability

To the maximum extent permitted by law, Grafnex shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to lost profits, lost campaign performance, or data loss. Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the event giving rise to the claim.

10. Governing law

These terms are governed by and construed in accordance with applicable law. Any disputes arising under these terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.

11. Changes to these terms

We may update these Terms of Service from time to time. We will notify active users of material changes by email. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
